Police investigating gunshots fired from vehicle

Sioux Falls, SD (KELO AM) - Tuesday night Metro Communications began receiving numerous calls about gunshots in the area of Madison Street and West Avenue shortly before 7. Several of the callers stated that a tan suburban was seen leaving the area, which officers confirmed from two witnesses upon arrival at the scene. Those witnesses said they saw the passenger of the vehicle shoot a handgun out of the front passenger window.

An officer located a possible match to the vehicle travelling eastbound on 6th Street at Duluth Avenue. That officer followed the vehicle eastbound through downtown until the vehicle ran the red light at 6th Street and Main Avenue, the vehicle then failed to yield when the officer attempted a traffic stop. The suspects turned southbound on Phillips Avenue and were finally stopped between 6th Street and 7th Street.

Both occupants of the vehicle were detained and upon search of the vehicle a hand gun was located in the center console. Officers also located a small amount of marijuana and paraphernalia. The driver was identified as 25 year old Khiry Smith, who was charged with Possession of Concealed Weapon, Possession of Marijuana less than 2oz, Possession of Paraphernalia, Open Container, Failure to Yield to Emergency Vehicle and a Red Light Violation.

The passenger was identified as 28 year old Jaunte Berry who was charged with being a Felon in Possession of a Firearm, Reckless Discharge of a Firearm from a vehicle, Possession of a Concealed Weapon, Possession of Marijuana less than 2oz, and Possession of Paraphernalia.

At this time there have been no reports of any injury or property damage from the shots fired.
