Prohibiting sale of fetal body parts moves to House

SIOUX FALLS, S.D. (KELO AM) -  Attorney General Marty Jackley says it is illegal to sell fetal body parts in South Dakota but he says there’s no penalty.

Jackley says Senate Bill 24 would make the crime a class six felony.

Jackley told the House State Affairs Committee today that whether your pro life or pro choice, he feels that all South Dakotans should agree we should not have the knowing and for profit sale of fetal body parts.            

Jackley says the law does allow donations of fetal tissue or organs in cases of spontaneous abortion and with the mother’s consent.

The measure passed unanimously in the Senate and was sent to the House floor on a 13 to 0 vote this morning in Pierre.
