Jackley prepares sentencing recommendation for Bosworth

SIOUX FALLS,. S.D. (KELO AM) - Former Senate candidate and Sioux Falls physician Dr. Annette Bosworth was found guilty last week by a Pierre jury of perjury and filing false documents.

Bosworth is accused of not properly gathering signatures on candidate petitions in her bid to become the Republican candidate for the U.S. Senate seat that was being vacated by Democrat Tim Johnson.

South Dakota Attorney General Marty Jackley says there are a number of factors that will go into his sentencing recommendation including how Bosworth will demonstrate an acceptance of responsibility.

Jackley says there's a presumption of limited or no actual jail time and he says that presumption can be overcome, sometimes, by a defendent's conduct.  He'll keep an eye on Bosworth's conduct over the next few weeks leading up tp sentencing.

An attorney for Bosworth says they plan to appeal to the state Supreme Court.  Sentencing is set for July.
