Dell Rapids, SD (KELO AM) - An 18 year old student at Dell Rapids Public High School has filed for a three year protection order against longtime band instructor Brian Smith.
She's accusing Smith of sending her sexually charged text and Facebook messages. KSFY TV's Mark Roper reports the nature of the messages ranged from Smith admitting he wanted to kiss the girl, to saying he thought of running away with her. Others were more graphic in nature, including one where Smith admitted that he's thought of the girl having sex.
One of the messages from Smith even stated that he knew the nature of his conversation was wrong, saying "please make sure you delete this from your phone, and computer. I could get fired for what I said tonight."
The messages were sent in late 2015. The student took out a temporary protection order against Smith on January 11th.
Smith has not been charged with any crime, the only thing against him is the temporary protection order, which runs through February 9th. That's also the date that Smith is expected to make a court appearance, where a judge will decided if a three year restraining order will be issued.
Messages sent from the girl to Smith said she is no longer comfortable around him. She adds that "you were the teacher I trusted the most. and now I avoid you, because I am scared of you and you make me feel horrible inside." The student also sent him a warning to not contact her unless it has to do with music, or else she would report him.
Administrators in Dell Rapids have not commented on Smith's employment status following the incident. Smith has also not commented on the protection order.
