PIERRE, S.D (KELO-AM) –   Attorney General Marty Jackley announced today that the lawsuit challenging the Secretary of State’s certification of the nominating petition filed by U.S. Senate candidate Annette Bosworth has been dismissed based upon lack of timeliness. The Court, much like the Attorney General, would not have the opportunity to address allegations before the ballots had to be printed and distributed to the county auditors. South Dakota state statutes require that the ballots must be delivered to the county auditors by Wednesday April 16th in order for absentee voting to begin on April 18th.

The Secretary of State’s Office originally certified Bosworth’s nominating petition on March 26th. On April 5th the Secretary of State rejected challenges again certifying the nominating petition.
